County Criminal Record Search

The County Criminal Record Search is the backbone of the criminal background screening process. FPL, Inc. utilizes a nationwide network of court researchers to retrieve information from county courts throughout the United States. When a County Criminal Record Search is requested, we send our researchers go directly to the county court where the researcher physically searches for criminal felony and misdemeanor (where allowable by law) on individual.

Turnaround time for a County Criminal Record Search varies from county to county, average turnaround time is one to three business days. County Criminal Record Search provides a minimum seven year search scope (where allowed by Federal and/or State Law).

When the County Criminal Record Search is packaged with the Social Security Address History service the employer is able to look back over a period of years for a criminal history.

Statewide Criminal History

A variety of options exist for Statewide Criminal History. Typically these searches are conducted using a private compiled database using public data or directly through state repositories.

Private Databases

Information in private databases varies from state to state depending on what information has been made available to the public. Common data sources include, but are not limited to, Administrative Office of the Court (AOC) records, Department of Corrections/Department of Rehabilitative Corrections Records, municipality arrest indices, court indices, state sex offender information. It is important to note that these search may not contains the data sources listed. Searches of this type are typically faster and more cost effective than state repository searches, but sometimes not as thorough.

When a record is located a secondary search is conducted at the county of jurisdiction of the original offense to confirm the database record.

State Repository

Criminal history repository searches are available in many states. The data contained in these repositories varies from state to state. While some states may contain felony and misdemeanor records, other may have felony records only. State repositories may also not reflect pending cases or cases not resulting in a conviction. Repository searches also have a longer turnaround time than searches at the county level.

Federal Criminal History

Federal Criminal History searches the Public Access to Court Electronic Records (PACER) maintained by the Administrative Office of the United States Courts.

Federal Criminal History records number far fewer than records at the county and state level. Federal Criminal History offenses range greatly in regards to the nature of the case. Examples of Federal Criminal History offenses are homicide, interstate trafficking, tax evasion, bank robbery, interstate mail fraud, immigration offenses, firearm and explosives.

Limitations of Federal Criminal Histories:

It is important to understand what is not included in a Federal Criminal History Search.

"Federal" coverage is NOT the same as national coverage or fingerprinting.

Coverage is limited to cases heard in United States Federal District Courts.

Federal charges will NOT be found at the state and county repositories.

National Sex Offender Public Registry (NSOPR) Search

The National Sex Offender Public Registry (NSOPR) Search provides a search of the National Sex Offender Registry maintained by the United States Department of Justice. This registry contains an aggregate of information provided from participating states.

If a record is located on an individual a secondary search will be performed in the county of jurisdiction where the charge originated. Once the original charge is returned we will compare the county data with the registry data to prevent possible misidentification of an applicant avoiding potentially embarrassment to the applicant and liability for our client.

National Criminal Indicator Search

National Criminal Indicator Search, sometimes called a Nationwide Search, is a compilation of public information from hundreds of data sources compiled into one proprietary private databases.

Coverage and Limitations:

Data varies depending on what information is made available by states, counties, and municipalities. Unfortunately there is no conclusive felony and misdemeanor nationwide search. We often recommend combining this service with County Criminal Histories.

Education Verification

Education Verification verifies the applicants claims in regards to their educational background. Where available we will verify school attended, dates of attendance, field of study, and degree earned.

We also screen for "diploma mills" which issue degrees without actual completing coursework for a degree. Diploma mill degrees are often hard to recognize because they often use names similar to real educational institutions. "Diploma Mills" also provide documentation and even verification phone numbers in an effort to pass off these degrees as legitimate.

Employment Verification

Employment Verification search verifies information the applicant has provided about their employment history. This search typically returns dates of employment, position, job duty, reason for leaving, and rehire status. Information that is reported varies from state to state depending on state law. Information may also be limited voluntarily by the employer depending on the employers company policy.

Employment Reference

Employment Reference verifies information provided by the applicant about their employment history. The reference subject will be and attempt to learn more about information in regards to dates of employment, position, job duty, work habits, performance, dependability, special skills and training, interaction with customers and co-workers, salary, reason for leaving and rehire status. Reportable information by be limited by state law.

Military Record Verification

Military Record Verification verifies an applicant's military service history. These types of services can often be tedious and time consuming for an already burdened human resources department. Using FPL you can free up your valuable manpower saving time and money.

Personal Reference

Personal Reference reveals information about an applicant's overall image as perceived by others. Common sources for personal references are friends, co-workers, former co-workers, relatives, business associates, and religious affiliation members. Questions asked during during a personal reference may answer questions relevant to job openings.

Professional/Occupational License and Certification Verifications

Professional Licenses and Certifications Verification verified license and certification an applicant has provided. This search will verify the applicant holds the license/certification, when the license was issued and license number. When available, any disciplinary action will be reported associated with the license. Information available varies among licensing authorities.

Almost all licenses can be verified through the issuing agency.

Driving Record Services

 

Moving Violation Report

Motor Vehicle Records Search (also called Driving Records, DMV Search, Moving Violation Report, or simply MVR) provides and individual's driving record and history filed with the State Department of Motor Vehicles.

While information provided varies from state to state, most often these reports include personal identifiers, driving history, infractions, license type. MVR searches may also provide and insight into criminal traffic convictions such as DUI/DWI.

Social Security Number & Credit Report Services

 

Employment Credit Report

Employment credit report is used in positions that require evaluation of an applicant's financial stability and other potentially valuable data. These reports show financial responsibility and promptness of an applicant's ability to meet regular financial obligations.

These reports may indicate pertinent public information such as collections, lawsuits or judgments, liens, and past employer information, including dates worked with particular prior employers.

Important Information

- Employment Credit Reports do not reveal credit scores, account numbers or spousal information.
- Use of credit reports should only be in limited capacities, such as high risk roles or where fiduciary responsibility is a question.
- Use of this service requires separate service agreement.
- Use of this service requires on-site inspection of End User.

Social Security Number Verification

Social Security Number Verification provides an address history and names associated with an applicant's provided social security number. This service can also indicate if the applicant's number appears in the Social Security Administrations death master index and prevent fraudulent use of a deceased persons social number.

When Social Security Number Verification is combined with Criminal History Services a complete criminal history background can be conducted.

Sanction Screening Services

 

Office of Inspector General (OIG) Search

FPL will search the Health and Human Services Office of Inspector General's List of Excluded Individual/Entities. Individuals/Entities are excluded based on program related fraud, patient abuse, licensing board actions, and default on Health Education Assistance Loans.

It is important for companies receiving Federal health programs payments to conduct this search. If you employ an excluded individual/entity you may not receive your Federal program payments.

Excluded Parties List System (EPLS) Search

FPL will search the Excluded Parties List System (EPLS) for individuals or firms that are excluded by the Federal government from receiving federal contracts, federally approved subcontracts, and certain types of federal financial and non financial assistance and benefits. Upon location of the record FPL will attempt to verify the record with the agency providing the exclusion.

The purpose of the EPLS is to provide a single comprehensive list of individual and firms excluded from certain Federal agency programs. This service is of importance to companies receiving certain types of Federal benefits or assistance.

Fraud and Abuse Control Information System (FACIS®)* Search

FPL will search the FACIS® database of sanctions including exclusions, termination of license, suspension, revocation, probation, and disbarments, etc. FACIS® is compiled from approximately 800 state and Federal public sources.

FACIS® provides three search levels:

Level 1 
- Level 1 conducts a search of the sanction information as taken by the Office of Inspector General (OIG), the General Services Administration (GSA) and other federal agencies. The information reported in this level meets the government's minimum requirements for sanction screening as set forth in the OIG's Compliance Program Guidance.

Level 2 - Level 2 combines the searches provided in Level 1 and one state of choice.

Level 3 - Level 3 is the most comprehensive and robust search method available. This level includes a search of all federal agencies and in addition those taken by licensing and certifications in all 50 states.

Workers Compensation Search

Workers Compensation Search provides detailed information regarding the filing of an applicant's prior Workers' Compensation Claims and injuries. Availability and information contained within these reports vary from state to state.

Important Notes About Workers' Compensation Search:

-These records can only be searched after a conditional job is made.
-American with Disabilities Action maintains strict federal standards for compliance.
-Records are subject to further Federal and state laws.
-Not Available in all states.
